Job Description

 

Our AML Compliance function is seeking people with a finely tuned sense of risk and the wherewithal to mitigate, manage and avoid such risk. 

 

BNY Mellon and its staff are committed to compliance with U.S. and applicable non-U.S. economic sanctions regimes in the jurisdictions in which it operates. 

 

The Sr Principle, Compliance & Control is appointed by and reports to Group Manager, Compliance & Control.  The position involves assisting in the leadership of the economic sanctions function and assumes the responsibility for provision of economic sanctions subject matter expertise to the Bank's business lines. 

This includes, but is not limited to, provision of sanctions advisory, development and enhancement of training programs, oversight of policies / procedures, and design, implementation, and oversight of sanctions controls and quality assurance framework, sanctions risk assessments,

interaction with governmental and supervisory bodies.  This responsibility extends to branches and subsidiaries of BNY Mellon both in the United States and abroad.      

  Key Responsibilities: 
  • Provision of oversight of regulatory requirements and sanctions subject matter support and guidance to the Bank's business lines
  • Continuously monitor and proactively develop initiatives to better manage sanctions risk for the Bank
  • Responsible for supporting the Bank in making informed decisions and judgments about any sanctions-related regulatory or reputational risks
  • Support the business in enhancing organizational and control structures to safely facilitate intended transactions in a well-defined compliance environment 
  • Interact with the Office of Foreign Assets Control and other related parties
  • Participate in internal governance committee and exchange with key regulatory and industry groups
  • Act as a point of escalation for sanctions related queries, incidents, and potential breaches
  • Drafting formal correspondence to OFAC administrative demands, including voluntary self-disclosures and subpoenas
In relation to sanctions risk assessment:
  • Responsible for the definition of sanctions risk appetite qualitative statements and quantitative metrics, tolerance, and thresholds
  • Accountable for the sanctions risk assessment
  • Responsible for review / approval of risk assessment control questions and setting of inherent data points
  • Responsible for validating regional / country risk assessment outputs
  • Review and sign-off of sanctions risk assessment methodology and reports
In relation to sanctions audit management:
  • Responsible for the successful resolution of self identified issues and audit findings, as appropriate 
In relation to sanctions controls and quality assurance:
  • Accountable for design, implementation and oversight of first and second line of defense sanctions controls and quality assurance framework
  • Oversee quality assurance activities
  • Review and sign-off on enhancement plans, as required
In relation to sanctions policies and procedures:
  • Accountable for definition and management of sanctions policies and procedures
  • Responsible for oversight of policy exemptions, exceptions, and potential breaches 
  • Review and sign-off of the sanctions policy framework
  • Provision of guidance to compliance stakeholders and the business on the interpretation of sanctions policies
In relation to sanctions training:
  • Responsible for development of sanctions training content and provision of guidance on specialist or high risk training programs
Applicant should have:
  • Subject matter expertise / knowledge of Office of Foreign Assets Control regulations as well as working knowledge of non-U.S. regulations related to sanctions
  • Significant experience in financial crime compliance within the financial sector
  • Prior experience working within government or a regulatory agency overseeing sanctions compliance 
  • Demonstrated industry leadership within the field of sanctions compliance
  • Experience working with regulatory bodies in the financial sector 
  • Experience driving and influencing change in global cross-cutting initiatives
  • Proven experience in building and leading teams
  • Proven experience interacting with senior management and the ability to build constructive partnerships with diverse stakeholders and challenge where required
  • Advanced degree from an accredited university

Qualifications

Bachelor s degree or the equivalent combination of education and experience is required. Business or Finance degree preferred. 15-18 years of total work experience preferred. Financial Services, Audit or Compliance background and/or experience with financial services compliance and/or experience with the assigned products, services or business lines/areas and the pertaining laws, regulations and rules of relevant regulators preferred.
