Vice President & Counsel- Brand Protection & Marketing

Job Description

This attorney will be part of the team within BNY Mellon’s Legal Department that is primary legal advisor to the global functional areas of Marketing, Corporate Communications, Technology, Digital, Resiliency, and is composed of SMEs on the substantive areas of intellectual property, marketing, cybersecurity and privacy law.  This role’s responsibilities include:

  • Develop strategy for and oversee trademark and domain name clearance, registration and enforcement practices, including portfolio management and strategy for all legal entities globally.

  • Oversee domestic and foreign counsel; manage third party IP monitoring and enforcement services.

  • Lead anti-fraud actions with respect to illegitimate domains, email addresses and phone numbers in collaboration with Information Security, Investigations and Corporate Security.

  • Implement processes and strategic plans to drive efficiency and digital transformation in the Company’s trademark and domain name practice.

  • Counsel stakeholders on trademark issues in client, partner, and vendor contracts, as well as M&A transactions.

  • Assist in supervision of IP paralegal.

  • Advise stakeholders on marketing law issues, including claim substantiation, copyright, fair use, endorsements, sponsorships and right to privacy and publicity.

  • Support digital development projects, branding initiatives, social media strategies and other promotional activities

  • Conduct periodic client training programs on marketing and IP issues.


  • 5+ years experience.

  • Strong working knowledge of trademark and marketing law.

  • Experience with brand enforcement activities including cease and desist letters, DMCA take down notices, UDRP proceedings, and oppositions before the USPTO and international trademark offices.

  • Familiarity with copyright, fair use, right of publicity.

  • Experience reviewing marketing materials is desirable.

  • In-house experience preferred.

  • Experience with supporting global projects desirable.

  • Must be articulate, organized, able to work in a collaborative manner and comfortable managing multiple matters at the same time involving different legal issues.  Appetite for learning is also critical.
